Meeting recap: February 21, 2013

Consent Docket
Councilor Phillip Pina requests item 'E' pulled. Council approves all items except for item 'E' 5-0.

e. Councilor Pina would like more information on clarification of "Geophysical Operations" on the north side of Lake McMurtry.

City Manager Dan Galloway clarified that there will be seismic testing of the land near Lake McMurtry. Test is the least evasive measure.

Council approves 5-0.
a. Receive public input regarding a request for a Map Amendment for property addressed as 799 E. Mercury Avenue from General Industrial (IG) to Residential Two-Family & Multi-Family (RTM). 

City did receive a protest petition on this Map Amendment, but did not meet requirements.

There are requests to speak 'in favor' and 'against.' There was also one presentation from Brian Frehner on behalf of the Lakeview Ridge Homeowners Association from the 'against' side.

Discussion involved on the intensity between the two zonings, rental properties in Lakeview Ridge neighborhood, and high volume traffic issues around the vicinity and the safety concerns with traffic.

Council did grant the opposition rebuttal time.

Planning Commission gave City Council 'no recommendation' on the Map Amendment request due to traffic concerns, setbacks with the adjacent properties to the south, and investment protection.

Councilor Cody Scott moves to reject the request of Map Amendment application. Councilor Joe Weaver seconds. Motion fails 2-2-1, with mayor John Bartley and vice mayor Chuck Hopkins voting 'no,' Councilors Cody Scott and Joe Weaver voting 'yes' and Councilor Phillip Pina abstaining.

Councilor Weaver motions to reconsider. Councilor Cody Scott seconds. Motion passes 5-0.

Councilor Scott moves to reject the request of Map Amendment application. Councilor Weaver seconds. Motion fails 2-2-1, with Mayor Bartley and Vice Mayor Hopkins voting 'no,' Councilors Scott and Weaver voting 'yes' and Councilor Pina abstaining.

Mayor Bartley motions to approve the Map Amendment application. Vice Mayor Hopkins seconds. Motion fails 1-4, with Mayor Bartley voting 'yes' and Vice Mayor Hopkins and Councilors Scott, Weaver and Pina voting 'no.'

Brief recess
b. Receive public input regarding a request from Alpha Omicron Pi for closing of portion of the alleyway adjacent to property addressed as 1401, 1407, 1423 W. 4th Avenue; 411, 415, 417 S. Gray Street, and 408, 412, 414, 424 S. Stanley Street.

One request time speak in favor of this request.

Staff recommends City Council to approve this request with conditions that all utilities in this alleyway closing must be relocated or abandoned.

Council approves 5-0.
c. Receive public input regarding a request from Terry Guthrie for a Certificate of Public Convenience and Necessity to operate a taxi service designated as City Cab.

City Manager Galloway recommends Council to issue permit to Terry Guthrie and his Cab Service.

Council approves 5-0.

General Orders
a. City of Stillwater Standards revisions

Water Utility Engineer Brandon Neal speaks before Council and recommends that City Council adopt the proposed standards by approving the resolution later down the agenda.

City Attorney John Dorman - withdraws executive session. Would like to mention that City prosecutor Dennis McGrath was reappointed to the state's polygraph examiners board. He mentioned it because McGrath was first appointed to this board in 1986 by former governor George Nigh and it makes him the longest person to serve on a state level board or commission in Oklahoma.

City Manager Dan Galloway - nothing to report.

Councilor Scott - brought up about more clarification in the future on what abstentions mean.

Mayor Bartley - mentions media appearances. Mentions One Book, One Community program coming up at the Stillwater Public Library. Study session on Monday, Feb 25 at the Holiday Inn on Country Club Road to go over visions and goals for the City of Stillwater. Public welcomed to attend.

Appointments

a. Stillwater Public Housing Authority
Mayor Bartley nominates Connie Stokes and David Spivey  for reappointment to another term.

Council approves 5-0.

Adjourn City Council meeting, move into Stillwater Utilities Authority after brief recess.
